Sidewalk Slip and Fall Injury, Who is Responsible?

Slip and Fall PremisesQuestion:

I Slipped and Fell, The medical center owns and occupies the first floor on one side of the condominium building. Who is responsible for sidewalk accident? The medical center or the condominium building?

The building is residential and has condominium association. First floor condo unit is owned by business. Owners of unit/business are four doctors who run medical business in their unit. There is no management company. It is a small building that is run by board/owners.

Answer:

This is an excellent question as there are many issues involved. It’s also a question that cannot be definitively answered until the necessary condo association documents, deeds, leases, etc can be reviewed. These documents should indicate which entity is responsible to maintain the sidewalk. The problem is that these necessary documents are not readily available to an attorney until a lawsuit has been commenced. The problem is that you would not want to sue each owner of the condo along with the condo association as that is very costly to serve process on each entity.
Without knowing anything more than the information provided in this question, at a minimum I would sue the condominium association, the medical office if it has a specific name, the owners of the medical office and individually the four doctors who run the medical office in their first floor unit.
