What is the Legal Process Involved when Selling a Property?

Selling a property is basically a function of New York State contract law. The contract is between a buyer and a seller to, at a future date, close and buy a property, exchanging money and a deed. The legal process is preparing that contract when I represent the buyer to make sure that they are protected, such as, we want representations from the seller that the electrical, the plumbing, the heating is in good shape and, for example, that the roof is free of leaks. When I represent a seller, I am preparing the contract and I make sure my client is protected  on his or her end as to all the conditions that the buyer must meet to go forward and have a closing.

Part of the process that occurs after the signing of a contract is the necessary title work to make sure that the seller can convey a good clear title, free of mortgages or other leans against the property. If it’s a buyer I’m representing, they have to get a mortgage in most situations, and I would help them through that process. The main legal process is the contract, which once signed and exchanged, is binding on the parties.
