How long do I have to file My Wrongful Death Lawsuit?

A wrongful death lawsuit in New York State must be brought within two years of the day of death. That is a contrast to the general rule that a person suing for personal injuries from a premises accident or mobile accident must sue in three years from the day of occurrence or malpractice cases into 6 months from the date of malpractice.

Wrongful death statues are shorter and things must be done before one has the authority to even proceed with the lawsuit mainly appointing an administrator or an executor of that deceased estate.

Some variations on a wrongful death can be if you already have a lawsuit pending for personal injuries or someone does not die immediately but lingers for a year or two.  This blog was provided by Irwin Weinstein, one of our experienced Brooklyn Wrongful Death attorneys.
