What to know about Wrongful Death Lawsuits

You may heard the term “wrongful death lawsuit” which is a recovery when someone dies as a result of negligence from any cause. This could be a motor vehicle accident in New York State,  a fall from the scaffold or be struck by a falling object at a construction site, or it can be as a result of medical malpractice which leads to a person’s death.

Now New York law provides that immediate next of kin are the ones who can recover and who benefit if there is a recovery in a wrongful death lawsuit. And don’t forget that a wrongful death lawsuit is most often accompanied by a claim which is also for the pain and suffering that the person had from the moment of the accident up until the time of the death.
